Both modles are sold side by side by Verizon.
Some will prefer the sleek 7.1mm model, others the 8.99mm model with bigger battery.
Rumors of the RAZR MAXX were well-known, even before the RAZR hit the shelves.
Also, Motorola has promised to make fewer models per year, to ave better support each model. The supper for the RAZR and RAZR MAXX will be the same.
Others, Like HTC and SE are also cutting down and will make fewer models per year.

But how will the software differentiate between the battery differences and convert it to the right percentage?

It's great that Razr Maxx is tied up with Main product of Razr Maxx, thanks to Moto. At please provide updates to these devices properly and not like Atrix. Still ICS not announced for a 8 moths old device(Month is calculated at the time of ICS launch)

..they should have just made a software to improve battery life rather than make a non GSM, no USB-OTG, no radio.....or do some market survey and make a worldwide user friendly maxx.

Looking at both devices' specifications (provided by you, GSMArena), it looks like the two devices aren't EXACTLY the same.
The RAZR MAXX lacks the "Advanced" SAMOLED (or perhaps it does have it, but you forgot to mention that - whatever "advanced" means). The RAZR MAXX also lacks GPRS and EDGE (baasically, 2G) and the 2 MP front-facing camera (has a 1.3 MP module instead).
Either the ROM has limitations (for specific hardware) that were pre-set in the first model's ROM), either it's a different one, in which case it would need a bit of tweaking.
Either way, the two devices are about the same. I doubt the screen differs. I don't see a reason for why the cameras would differ, either.
But for that big kick-ass battery... I'd kick heads.
