All your comments gentlemen are well noted. If you jailbreak your iphone to maximize the capability of your iphone then there is nothing wrong about it. However, if you jailbreak your phone with the intention of getting and installing paid apps without paying the apps developer, then this is illegal. Let us support the hardworking apps developers by paying for their apps and not short change them. We buy our Iphone and other smartphones but this does not allow us to get and install paid apps without paying the developer. The paid apps are not integral part of the iphone. So please if you jailbreak your iphone that is your right but also make sure that honest and hardworking apps developers are properly compensated. Pay what is due them. I emphasize this point because when I talk to people who jailbreak their iphone, their main and only objective is to get the paid applications for free. Apple can sue because they have money to pay their lawyers and court expenses. But the application developers/programmers have limited resources to pay lawyers to run after these people who steal their paid applications. Let us support these developers. My concern is that if the developers stop making the apps, our iphone or any smartphone will be having limited good applications.

Simple you go into a store or online and you spend your money for a product, that product belongs to you and you have all the power to use that to suit your needs and if that product is an iPhone and you need to jailbreak it to your liking then that company have no right to tell you that your action is wrong because it your cash that paid for that iPhone and you are free to tweak it to suit your needs.

Yes, jailbreaking aides in obtaining apps without paying for them. But it does more than just that – it allows people to download none-Apple approved apps (there are companies that want their users to be able to download it anyway) and customize the phone in ways an untouched phone can’t be customized. That’s why I’m saying the jailbreaking process isn’t illegal, it’s what you do after your jailbroke it that matters.

I have a really large, sharp and pointy kitchen knife that can do terrible things to people. Instead I use it to slice and cut my food with. It’s not the tool (e.g. jailbreaking) that is harmful, it’s what you do with it (downloading paid apps for free). I think this difference is what led a… Dutch/German/some European court to announce that there is no reason to consider jailbreaking illegal. I know that if I were to get an iPhone, I could legally jailbreak it without a problem, I’d just give up my warranty for altering the device.

I think it’s important people know this difference.

              Cheers from a Dutch girl-nerd.

So let us put it in a different way, the jailbreak process is an accessories to do illegal download and thus illegal. If you have a legally owned gun and you use is in robbery or killing, the use of the gun voided its legality because it is used in an illegal action. Look at reality as jailbreaking is used for to get paid apps for free. Please note that I had googled it already and read the entire subject and fully understand the legal (and illegal) context of jailbreaking. Appreciate your point as this will help our co-Iphone owners understand various points and opinions regarding jailbreaking. Thanks for the opportunity to view 2 sides of a discussion. Good day to my co-iphone fanboys.

Gil Bald, 21 Sep 2011Jailbreaking is illegal as this violates copyrights law and... moreJailbreaking is legal, as determined by a judge some time ago. Google it if you like. I don’t know where you get your info from, but jailbreaking doesn’t break any law whatsoever (if you still believe it does, please specify which law exactly that is). The act of jailbreaking only voids the warranty because you are modifying the phone in a way that may cause damages that aren’t the liability of the producer of the product. If you put a screwdriver into your microwave and mess around with it, and it then stops working, you voided the microwave’s warranty as well. It’s the same thing.

Jailbreaking means you enable certain aspects of the phone, but as you OWN the phone you’re free to do with it as you please. The act itself is NOT illegal.

When I jailbreak a phone, I’m not downloading an app illegally. That is an entirely different action that I have to take AFTER jailbreaking and it stands alone. Therefore, jailbreaking is not illegal. Downloading an app without paying is. There is a difference.

If you take a jailbroken phone to an apple store they will refuse maintenance on your phone, yeah. If I take a microwave to the store after jamming a screwdriver into it, they’ll refuse to do maintenance on it too. That’s because you modified it and the product isn’t in its original production state anymore. It’s common knowledge, you know.

The American Customer Satisfaction Index (ASCI) today released its latest results on U.S. consumer satisfaction in the personal computer industry, with Apple topping the charts for the eighth consecutive year and setting a new company high for ratings.
Apple’s record of customer satisfaction preeminence in the personal computer industry continues unabated in 2011, as the company adds another point to its already exceptional score. At 87 (+1%), Apple outdistances its nearest competitor by 9 points.

“In the eight years that Apple has led the PC industry in customer satisfaction, its stock price has increased by 2,300%,” remarks Claes Fornell, founder of the ACSI and author of The Satisfied Customer: Winners and Losers in the Battle for Buyer Preference. “Apple’s winning combination of innovation and product diversification—including spinning off technologies into entirely new directions—has kept the company consistently at the leading edge.”
Apple's score of 87 rose by one point over last year's score of 86 that had been its previous record high in the survey. This marks the third straight year that Apple has held a nine-point lead over its nearest competitor in the industry.

Now if you download paid Iphone apps without paying, then you are violating the law. Also, if jailbreaking is legal, trying suing the jailbreakers if they bricked your phone and you'll find out. If the jailbreaks are legal, how come they are not registered. Now get the point. I love the performance of my Iphone 4 with its legal operating parameters. I paid for my iphone apps, my phone is protected by Apple warranty and can bring this phone for routine maintenance to any Apple Iphone service center and my phone service provider without any worry or fear that I had done anything illegal. If you can do these actions with your jailbroken iphone and get full support from Iphone service center and your phone service provbider then jailbreaking is really legal after all. If not, then jailbreaking is illegal.
