Now look, lets say you research some very rare and alm... moreYour example and your argument are in contradiction; you say the first entity to patent should get the profits but then suggest the first person to have the their test marked didn't deserve the high grade.
Additionally I don't think it's applicable here because one of the bases of apple's case was that they did a rectangle with rounded corners before samsung which is just a natural shape. To use your test example it would be like a teacher marking everyone but the first person wrong for deciding 2+2=4.

If I were Apple, I will transfer my business to other countries. Pay their tax in other country. Apple will be at a disadvantage from hereon in the US, since they are at odds with the US government over data security. And US justice will now side with their competitors whether Apple is right or wrong...

Now look, lets say you research some very rare and almost impossible technology, which could give you billions, and when prduct is done, you start selling advertising and etc, and another company looks and thinks 'hmm, why cant we do the same? i mean, he earns a lot of money out of this' and then after few days you see company seeling same stufc as you, if not a little bit modified and you starting lose buisness, or starting war.
Company when finds a technology, patents, so nobody can steal their idea. If another company starts research at the same day, then the luck will be, which one patents faster, if first one company patents first, then no matter what were made second company if it is already patented.
One more exmple, when you do test in class, and you learn a lot as you can, 1-2 days or so, and your friend is having fun at home like always, and he comes to class with a pain that he didnt learn for test, and he will sit next to you on test and copy answers from you. Next day you come to class and see that you get negative mark. And friend gets either highest mark or wayy higher than you, and how you feel this? (copy guy got highest mark cuz teacher fixed test first, and then teacher might think that guy which was learning for 1-2 days copied from a friend. Thats The same with thechonoly, if there is no patent, but techbology exists, si its enough just to take technology and start selling.
Patent is a tool against money, technology stealing. Also dont forget that you can SELL patent to other company, so more money, so they can use same technology as you.

Biggest example of this is Phone. Alexander Bell is known as inventor of phone.but its controversial,everyone knows tht.
In reality Antonio Meucci made it 1st.Bell has just stolen his project n he has just patent it 1st.
