                    Basically all Smart Watches work the same as the Sony Ericsson from 2008, there is nothing new there .. only some apps or NFC that came later.

                        If you plan to sell 100, at a low price point the chance of you getting caught and the patent holder bothers to pursue you is low.

                        It also matters how prominent the feature is for your products functionality.
                        If you make a huge machine selling in low volumes that on the back has say a reset button that happens to infringe a patent, it is not very likely that it will be something that can not be handled amiably if found out.

We all know Apple does own the factories. When you are referring to your work place do you say "my work place" or do you say "the owner's place that I work at" because if you do then you are unique.

                                Prima Facie, any neutral person would consider Apple wrong, and only fanboys would favour. Read again:-

                                "Masimo's CEO says that the meeting's purpose was to poach certain employees and extract information and expertise on certain Masimo products."
                                "Apple really did sign Masimo's chief medical officer shortly after the meeting, though."

                                Isn't Masimo's CEO right here (just talking about poaching, not patents)?
                                Why are people getting so worked up? Apple will get a little hate, it won't close their company, don't worry. Another day will come, customers will forget. I've been seeing this for 17 years now.

The point is that it's ridiculous to downplay wrongdoings by saying that there are worse wrongdoers. Apple doesn't care about the likes of you, you know? Your claim that infringing patents is practically inevitable clearly shows that you don't know how patents work. Patents and copyrights are similar; patents protect inventions and copyrights protect original works. If you want to use a patented invention in your product, you can get a patent licensing agreement from the patent owner. In the same way, if you want to use copyrighted work in your work, you can get a license from the copyright owner. This is how business works. Saying that all companies infringe patents is ridiculous and ignorant. Also, patents aren't perpetual. Generally, they expire in 20 years.
