That is their fee for their product, you can haggle if you wish to NOT use the license and then haggle until you get a deal where you then CAN use it. But clearly they are trying to haggle in the midst of stealing the tech licenses and not paying for them.

    The article title is very true though, it's matter of fact that the chinese court sided with Oppo in this case, your use of the word colony is then a negative and purposeful connotation but this article can be read without your particular interpretation. You've injected the negativity into it.

    Sadly the Chinese courts seem to be potentially biased at the moment and it is disappointed but the article states nothing more than the result which is as matter as fact as you can get. I do agree with you that China does need calling out on it's malpractices though.

      The article title of "Chinese court sides with Oppo over Nokia patent dispute" is such a pathetic way of putting it. I will oppose China all day for the crap that country pulls all the time.

      But still, it does not justify writing such a biase article, imagine writing "European court supports European company against Chinese company which is a former colony".
      Back then, the article supported the Courts but now it is a different country so this kind of a comment is not correct.

I... moreThe point of FRAND licensing is that everyone should have the same access and pay the same reasonable licence fee for the use of an essential patent. The Court would have evidence of the reasonable licence fee everyone else has been paying for use of the patent and Nokia cannot charge Oppo anymore than the reasonable licence fee everyone else is paying. Oppo has alleged that they're being overcharged by Nokia and the Chinese courts have now set the reasonable licence fee that they should pay for the use of the patent. The European courts have yet to rule on this but if they apply the same FRAND principles, they should come to the same conclusion.

            Some posters seem a little confused here. So, as a reminder -

            China is not a democratic country.

            It is a one party state run by the Chinese Communist Party.

            There is no separation between the judicial system and the state. They are not independent. They do not make independent decisions.

            The courts implement the policies of the CCP.

If it's crucial patent for you, you will have to pay the price that the provider asks. That's the reason the provider is putting in the effort and money to develop that technology and get patent.
                                If it's something related to life threatening issues or something, then that can be fine. Even in that case the regulators should be fair to the patent creator, so that they don't demotivate them from innovation.
