JLC, 21 Dec 2023Finally, the biggest patent troll company in the mankind... moreUnbelievably and despite no Presidential Veto the Appeals Court has allowed Apples Appeal, not based on any legal consideration at all.
The ITC has until 10/01/24 to consider Apples Appeal how ever Apple can resume sales in the interim.
Presumably there will be another article in Gsmarena.
I have read a few stories about this successful Appeal? one has even described is as unexpected.
Details about was uncovered (unknown to me until now) were also revealed, I was futher shocked!
Hopefully it will figure in the new article even if true*
repetition now would show my bias.
Am I right in saying that Presidental Vetos are used to get around legally flawed submissions.

Apple tricks people into thinking they'll stop selling smartwatches until the 24th to sell more. After making money, they'll quickly sort things out with Masimo.

The SOURCE for the18/12/23 "Apple pulls Watch Series 9 and Watch Ultra 2 from US stores due to ITC ban" is way better. Ok here it is https://9to5mac.com/2023/12/18/apple-halting-apple-watch-series-9-and-apple-watch-ultra-2-sales/
I had to cut and paste this. I read Apples is trying to justify its patent the Patent Theft
"The company also emphasizes the Apple Watch’s life-saving ability to help users discover potential issues with their health. In its lobbying with the United States Trade Representation, Apple has enlisted the American Heart Association and other leading health organizations and physicians to tout the health benefits of the Apple Watch hardware."
From the Inventors of Modern Pulse Oximeters From the Inventors of Modern Pulse Oximeters Masimo Masimo W1® Sport Advanced Health Tracking Wearable https://www.masimopersonalhealth.com/products/masimo-w1
The finger pulse oximeter is a small diagnostic tool . You may at some point in your life have a Doctor slip the device on your finger and check your Oxygenated blood level. The results will usually be above 96% however in say after an "accident" paramedic check you are / still getting enough O2 as this may not be obvious.
Sleep apnoea where there may be a temporary cessation of breathing. Diagnosis by overnight monitoring. Smart watches were not 'primarily designed to be diagnostic tools' My point is any medical diagnostic implications would, have already been known.
The exception when Spo2 devices "took off" during the COVID Pandemic due to Life threatening drop in O2 you feel fine but are in a state of worsening and potentially irreversible crisis
Apple management almost seem to be genetically opposed to LEGALLY acquiring patents. I just get the feeling that they want the myth that they discovered it / utilised it before the legitimate or patent holder did
from the same article "There are other paths Apple can pursue, including a potential settlement and licensing agreement with Masimo. It can also attempt to design around those two Masimo patents, such as with firmware changes to the Apple Watch software."
de facto no Apple would have designed a workaround already; that in itself shows the TRUE Patent Holder

It's good that justice finally prevails. But I doubt that it will make much dent in Apple's wallet. Satan won't be easily defeated.

The main thing to take from this is that Apple can, at any time, pay Massimo and resolve this, but they opt not to. What does this tell you?

To all of the people who were attacking Nokia and praising Huawei: This is how IP works in Western/functional countries. No one is above the law and everyone has to make a deal and pay up, or go without infringing on patents. It's quite simple.
