It is true that all Android phones spy on you (because of Google Services) but there isn't anything that forces you to upgrade. If you don't wanna be spied on the only possibility is not using a phone (or any modern computer really). I know...

I've been using my Samsung phone for >5 years now and it hasn't forced me to upgrade. Maybe put down that tinfoil hat every now and then
