Also, if you're saying SEP can not be used for litigation, what reason is there to contribute to a SEP if some late comers to the party have never contributed to the SEP and are just takers and freeloading off others' development, refusing to negotiate and demand low low rates. If this is the way things are headed, I see there being less a desire to contribute to a SEP bringing us back to days of non-interoperability.

If these patent were not lost by samsung it would be the most richest company in the world because samsungs 20% approx. profit goes into these useless trials and hence, apple gains profit.

Samsung is the sleaziest company. Who uses SEPs as a weapon? That goes against the entire purpose of an SEP. That's why the the EU is about to slap them with an $18 billion (yes billion with a "b") fine for trying to be so underhanded. This is not Korea where you can bribe your way out of everything.
