Apple sued over iOS 9's WiFi Assist feature

A Florida-based couple has filed a class action lawsuit against Apple, claiming that the iPhone-maker didn't clearly explain how the WiFi Assist feature in iOS 9 affects cellular data consumption. The couple has accused the company of violating California's Unfair Competition Law and False Advertising Law, as well as of negligent misrepresentation, and is demanding $5 million in damages.

          i think they should put a band on suing for stupid stuff.. cause these people sue for any and everything. they should read and understand the product and know how to operate a smart before they buy one

Why sue apple when this is the feature of all smartphones. My cheap android phone is also doing this. I never complained cuz it will be my fault paying for extra charges. Then it's the couple's fault not apple's. ignorance is not an excuse.

                  This is very basic, they should turn off cellular data. Every phone consumes data even if the phone is connected with wi-fi. My phone is a cheap android phone and has been connected to our wi-fi modem, however, I forgot my cellular data was turned on and I was charged for using the internet for 4 hours. They should read their manual.

I worked for o2 in the UK for nine years and I know they all Galaxy's with the feature on o2 had it enabled by default but you're correct it did have a warning about possible extra data charges.

                                  AnonD-2332, 24 Oct 2015This feature has been on Samsung for a few years now and on... morefirst for the sad part, apple will probably settle out of court and the family knows it, because of the cost associated with fighting it in court. it will be cheaper to settle for the company. unless they can get it thrown out for being unbiased. and it california that is surprisingly hard to do. why do you think everything has warning labels on it now.

                                  secondly the samsungs wernt turned on by default. even note 2's had it , but it was off by default. and it even gives a warning when you enable it about data charges. not to mention when you use it. it flashes connecting to data or connecting to wifi network any time it changes.
