The seller has ONE attemt to repair. In difficult cases he can have more tries.
You have 3 years warranty on the repair.
The seller has only 14 days to repair.

Its shame that we have to get refurbished ones. Here is my story with AT&T Samsung Note4. The phone was changed 32 times. The last 2 were refurbished. Were they any better? Of course not!

There ARE no easy general answer to what is fair for both the buyer and seller.

imagine it was the same with cars.. yo buy a ice new one, treat it well and rarely use it, as example say you did 10k.
then it went faulty and they had to replace it.
so if they gave you a refurbished one, so all new paint and interior, but it had done 100k from the previous user. would you be happy?
also then would you be sure it went another 100k...
its the same with phones.
the components have a finite use. if you get refurbished you don't know what you are getting or how long it will last

It is only after you have started using a product and it breaks down, that the manufacturer can choose to repair it.

As I said there are no clear right/wrong here, but if the consequence of this sentence is that a company ALWAYS have to provide a new item, I think it is a quite radical take on the term warranty. It will sort of force sellers to not offer replacements but instead send each actual defective unit up for repair, thus leaving the user without their unit for a long time.
I once had a monitor that I bought online, that was defective when it arrived.
Had I send it back and said I did not want it, they would have had to give me my money back. Now I was honest and said it was defective, and they would not refund, but let me wait for weeks...
And when I finally received it again I immediately returned it and asked for my money back - and got them, as they acknowledged that the 14 days return period must be when I have the item.... (I had bought another monitor elsewhere in the mean time)

And very important, this article gives the reader the impression that it was the consumer (David) who filed the lawsuit.
That is not correct, actually it was Apple who sued David to force him withdraw his claim. Despite the fact that the law is clear in Denmark on this. Apple was defending themselves saying that a refurbished device is as good as a new device.
But just the fact that Apple themselves sells refurbished devices cheaper than new contradicts their argument.

First of all a company (Apple) has three attempts to repair the device, if the (same) fault still happens with the device after third attempt, then the customer is entitled to a NEW replacement device.
A company must repair a device within reasonable time. What is reasonable time? It is actually up to two months. In other words a customer could experience not having his device for as long as 6 months in total, before the company, by law, must replace with a brand new device.

Scenario a) You just bought the device, and a few days&weeks in it fails, the a refurbished device would be bad for the customer
Scenario b) Your phone breaks down a few days before the warranty expires, here it is not really fair to the seller to have to provide a brand new device.
The Danish court have taken a radical decision saying that any swap should be in favour of the customer...
Actually there is an import part of this story in that the customer requested to get his device back instead of the refurbished one he got, And aPple refused that.

Do you even understand what "refurbished" means?
So lets say I have a one month old iPhone that dies. I might get back a 19 month old iPhone that died and was "fixed." I put that in quotes becuase some problems are harder to find than others and broken phones can have multiple problems.
So now I have a phone that is patched up and 19 months old, a month after I got my new iPhone. How long do you think this "new" phone will last?
But Apple does give it a new case and new plastic wrapping. I guess that's enough for most people, lol.

Most people commenting are from countires that don't even have apple stores. So my 19 month old iphone 5s developed a signle dead pixel! Walked into an apple store and left with a refurbished phone that looked and performed like new. Seriouly the phone was still erapped in the protective films and everything without the tiniest indiciation of it being refurbished. Other comoanies repair the phones apple gives refurbished. So Denmark demands that phones are repaired instead.

If the... moreActually that is not the best depiction of the problem, because while it is true that you bought it new, when you deliver it for service it is actually in used condition. In your own formulation, a replacement in equal condition would still be an used device.
The thing is, a phone is a personal item. It's about the number of owners and how it was used/handled, not it's condition.
I personally dislike rubbing in my face something that could very well have been inside a toilet or (at bare least) has someone else's spit in it.
