    If legally bought device is dangerous for life and property,any corrective action to stop the damage is deemed legal.

    Legal provisions are in place for safeguard of life an property,any and all actions taken in that interest is legal.

    And Samsung is ready to replace with an alternative by cash or kind. Still if you argue for legality is not correct. That's over smart of you.

      (even though 4096 degrees of pressure, full water resistance for BOTH phone and pen. and v3.1 USB. PLUS inner storage 64 GB PLUS 4 GB ram. and the most powerful chipset sounds tempting. I wouldn't risk my life for such treasure)

            But that was not the main point, the point was is someone are allowed to maim your device?

            Is someone allowed to enter your home and maim your legally bought gun with a hammer to say reduce the capacity for the number of shells it can hold?

              What about the people who have bought the Samsung 360 camera,the gear vr which is brand specific? The S7 no matter how you slice it is a downgrade to note 7 owners who paid full price for it. Maybe if they (samsung) were to offer us early release of the note 8 or S8, they would EASILY get ALL REMAINING NOTE 7'S!!!

                      If I were a Note 7 owner / user, I would never return it. I would keep it forever and I would disable all automatic updates to protect my device from Samsung.

                          Since I have gear watch and gear fit I don't have a choice but to get an S7 edge instead to replace the Note 7. 1 month later the S7 edge screen just won't stop flickering and is unusable. And I have to pay an out of pocket to claim for warranty. Samsung made a very bad reputation lately. I can't get myself to switch to apple, it can never match the flexibility of an android phone and the price is just ridiculous for a limited specs.

In fact, holding on to a recalled device is much closer to being illegal than disabling one with an update. If the device were to combust, the user would be held liable for any damages and they could be brought to court.

                              Samsung as a OEM has deemed the device unsafe and has urged to return it without fail. Any responsible human will not like to put others life in danger.

                              if it is your RIGHT to keep the device, then accept the fact that is your RESPONSIBILITY as well to ensure others safety and well being. RIGHTS and RESPONSIBILITIES in a cultured society go hand in hand. No one has RIGHT to risk others safety.

                              And by the way with official announcements for returning the device, no legal authority will cover the owner. The owner himself / herself will be a culprit for keeping the device which has been declared unsafe by the manufacturer. Owner will be liable for legal actions for keeping a unsafe device.

                                  Sure they offer swaps or money back, but I guess that in most countries you can not REQUIRE people to return it. In some countries even automatic guns are allowed with no special permissions or education so why not a potentially burning phone?

                                    Battery has no space to expand, and the pressure results with a volatile chemical reaction. I'm skipping the Note8 entirely and wait for Samsung to pull their $#!# together.

                                    I've moved on to a 256 GB iPhone 7 Plus by tomorrow, as I've lost confidence with Samsung's manufacturing quality. I want that 250+ GB of disk storage, especially for Spotify and Netflix are downloadable.
