AnonD-16342, 11 Aug 2011Sorry... I am not a professor of history but I know wheel w... moreAgain, go over the definition of a patent, and make it a point to MARK the highlighted text, since you obviously didn't understand it the first time round: "A patent is a set of exclusive rights granted by a state to an INVENTOR (note it down: it says "inventor," which means somebody that INVENTS something NEW) or their assignee for a limited period of time in exchange for the public disclosure of an invention.
Now, for the rest:
"...copy a Ferrari 458 bodywork inside your garage, put a Focus's engine and put it for sale.... and be amazed when Fiat comes suing you for design infringement."
Yep. That would be true. Because Ferrari DESIGNED the 458. They INVENTED the design.
"Get a bottle of Pepsi cola from the market, fill it up with any other cola flavored liquid and tear off the label, and put a new label as "EDDIE
COLA" and try to sell it ..... and also don't complain when you'll be convicted for duplicating the "bottle design".......
Yep. Again true. Because Pepsi DESIGNED the bottle. They INVENTED the design.
"A rectangular product shape with all four corners uniformly rounded." Been going on long before Apple started making mobile phones. Therefore, Apple DID NOT design. Apple DID NOT invent. See the difference yet?
So next time, mate, come up with a better argument.

What you are saying is that....... in other words..
" Every company build cars with two headlights in front, a windscreen, maybe 4 seats, a boot and an engine which is also in internal combustion engine......."... so no harm...
So go on.... copy a Ferrari 458 bodywork inside your garage, put a Focus's engine and put it for sale.... and be amazed when Fiat comes suing you for design infringement....
or Try a simple one....
Get a bottle of Pepsi cola from the market, fill it up with any other cola flavored liquid and tear off the label, and put a new label as "EDDIE COLA" and try to sell it ..... and also don't complain when you'll be convicted for duplicating the "bottle design".......

AnonD-16342, 11 Aug 2011The only difference is the Wheel was invented by somebody w... moreYep. Darwinism is "history." And humans--or, should we say, monkeys--ate panthers and tigers. And they used to "crawl" amongst trees. Some history you've learned there, mate.
Anyways, here's a definition of a "patent" for you:
"A patent is a set of exclusive rights granted by a state (national government) to an INVENTOR or their assignee for a limited period of time in exchange for the public disclosure of an invention." (Wikipedia)
Apple DID NOT invent "a rectangular product shape with all four corners uniformly rounded." The shape's been in existence ever since mobile phones have been in existence. Nor did they invent "a metallic surround framing the perimeter of the top surface" or "the front surface of the product dominated by a screen surface with black borders." Nokia, Motorola, Samsung etc. have been going with these designs long before Apple decided to foray into the mobile industry. So, in other words, Apple CANNOT patent those designs, and it CANNOT use them to claim patent infringements. Looks and icons, I understand, but not ludicrous claims like these.

Don't be selfish. Why should Samsung copy Apple. Samsung should hire skilled developers than wait to copy other companies product. Anyone in business wouldn't want that. Be fair minded.

The only reason I can find for Apple to file these obviously frivolous lawsuits is that they needed to buy some time to work on their iPhone 5... They must figure that iPhone 5 profit will outweigh any court expenses, and sadly, I'm sure they're right... Sick how companies can start these frivolous lawsuits and still come out on top, ain't it.

Rectangular device with rounded corners
Front-facing screen with black border

Truth is, Apple wants to get rid of ALL competition, so that everybody will be forced to buy ONLY Apple, nothing more. Getting patents on stuff like "a rectangular product with all four corners uniformly rounded" is ridiculous, to say the least. What other shapes are manufacturers supposed to employ in their designs? And what if a second manufacturer decides to get a patent on "a rectangular product with all four corners pointed"? THEN, what are the others supposed to do? Start manufacturing round- and cylindrical-shaped phones?
That said, however, Samsung, have taken this a little too far. They've been blatantly copying Apple's designs. When the iPad 2 came out, they said they were going to "have to go back to the drawing board." The menu layout of their Galaxy range of phones has been a complete knock-off of the layout of the iOS, icons included. Not to mention the looks of their phones, especially the Galaxy Ace. You'd think that, when creating their own OS (Bada), they would've had their own original ideas and come up with something unique--like Symbian, Meego, the Blackberry OS--that wasn't a copy of an existing OS. However, what they came up with, instead, was a cross between the iOS and Android.
Samsung are truly devoid of ideas and originality, and in some way, I feel it's a good thing that this has happened, because there was a pressing need to shake them up. Maybe, at least now, they'll go "back to the drawing board" and create some original designs of their own.
