And since it is a free market you can charge how much you want for that license. What you sell it's free for you to use, while for other it is a cost they have to take into account. So theoretically you can still have a price point advantage on the same product.

Stupid judgements like these are part of the reason that nobody respects U.S law. All it will do is stifle ingenuity and allow big companies to profit without the cost of research. Consumers these days do not profit from competition as evidenced by mobile phone prices from the major players.
