Zen mobile, I never heard of them who is that judge there is a asus before zenfone branding so why would anyone get confused between Asus zenfone and zen mobiles. When it entered the Indian market since 2014, why Telecare didnÂ’t claim earlier ?? Asus is using zenfone name for a long time now he says they should change the brand name to something else. This is like when fish little Nemo is trying to swallow big white whale and whole. Apple is a trademark, but when it's used by others and Apple goes to court, they don't get to win, as the word is too common.

evilmessiah, 06 Jun 2019In case of the Maruti car, it was ZEN, an acronym for Zero... moreNobody knows that! The car was marketed just as Zen and that's how it was sold too!

well, is better ASUS get out of India as fast as they can cause the brand do nothing there, if some indian person want a Zenfone 6 they can import it for theirself and ASUS dont need to bother about pay to "ZenMobile" or whatever to have the name...or better, dont need to change the name they always use since 2012.
ASUS, just dont enter Indian market, its easy...as most of Indians will buy Xiaomi, Samsung and other brands, ASUS market share in india is very very very...almost non existent.
And if they chose to change the name...then will be not fluent with other markets, cause in other markets is Zenfone, in india they will call it Gipsy or whatever they want...make no sense, remember me of LG here in Portugal need to change the name of LG Optimus to LG Maximo cause here have a celular network named Optimus and then only here LG change it to Maximo, Maximo L3, Maximo L5, Maximo L7.
LG decision was bad since Optimus doesnt exist anymore, it was bought by another company so...hope ASUS dont destroy their brand because a little sh*tty small company like that.

If they used the name ASUS from the beginning, probably they got more sales. Zen sounds cheap. ASUS was regarded as one of the pioneer in computer industry.

evilmessiah, 06 Jun 2019@Teddy G You're right. Asus should settle up with them, get... moreAsus can send the phones initially destined to India to other Asian countries without problems. And in a few weeks, have another registered trademark for India and new exclusive manuals for that country ready. Even simplified and cheaper with only one language. The boxes cost little. It would be money invested for the future instead of throwing it in the trash in an opportunistic company that will also keep asking for the brand share forever.
The only bad thing is that in India customers will have to wait some time to be able to buy those phones. Thanks to Telecare Network for that.

@Teddy G You're right. Asus should settle up with them, get an NOC from them in this regard and go ahead with using the Zenfone name- from a business and practical point of view. It's cheaper than changing the brand name in all the adverts and software to reflect the change of name.

How Stupid can high court judges be, did he check how many phones does this Zen brand sell and the revenue. Google search shows some stupid, cheap low end devices no one would bother giving then a look. And what were they doing since 2014. It also seems like these junk heads copied the Zen name from Maruthi (Zen Car).
Hopefully the case gets thrown out of window and sense prevails.

Mr. Anonymous, 05 Jun 2019Stupid decision by Indian court.
Zen comes from Buddhism a... moreYeah, like Apple or Galaxy can't be trademarked (they are).
But I agree this is stupid. Companies should come up with their own names and trademark them, not use existing words in any language. That would make legislation way easier.
