Dutch court finds Galaxy Ace, S, and S II infringing an Apple patent

Ruling is preliminary and is based only on the way photos get touch scrolled in the Gallery in Android 2.x.

samsung open your eyes :-) and you should focus more about bada not about android because now google buy moto . always google used new version android on his devices . and about copy :( samsung you copied apple :( . this unfair samsung change the menu .

    Apple, why to develop something new if I can take my competitors out of the game.
    It's a shame, that's why there's so few advancements from what could be really happening. You take more time studying the patents apliance than developing hardware.

      thats just bullshit!!!!i mean c,mon!man!samsung copying apple?i,ve been using the i9000 since the last week and its better then the 2g,3g,3gs,4g .and its android !!!! how can android b infringing the patents of IOS.if it is then htc and xperia is also infringing!!!!y dont the apple sue them???u know what i say!!!!i say that apple is just scared that samsung might take over the european mobile market and then no one will give a shit to iphone

        It's sad that nowadays what we call a "technological progress" is reduced to competing who will invent more eye-candy page transitions. No substance, no meaning, just stupidity. And we are cheering like we are on some football match. Thank you Apple for this, you gave us what we really wanted (not what we thought we wanted).

          well its a shame. i feel a bit sorry for samsung. but then you must think. the reason why the galaxy s is such a good is because its complete rip off of the the iphone.

          samsung are great innovators, at the same time the word copy cats comes to mind. its a harsh life in business. but the good guy always wins in the end. well done Apple.

            A more accurate headline would be something like "Dutch court throws out most Apple claims, agrees on one, expects Samsung to not infringe it by the time ruling comes to force"

            All patent claims except one were judged as irrelevant to the case (with the judge commenting that he expects at least one to be simply nullified later on); and, most importantly, design claims were thrown out (the judge essentially saying that minimalism isn't one)

            Samsung just has to make a slight change to Gallery app before October. If anything, that's a win for Samsung. Apple didn't accomplish anything, their claims have just been made much weaker.

              Here’s a small victory (if you can call it that) for Samsung up against the possibility that they may have had to cease sales and advertisement of the Galaxy S, S II and Ace. They claimed Samsung violated patents of Apple’s which describe sliding on-screen to unlock a device and scrolling in the gallery (and the “bounce” after you hit the beginning or end of a list of photos). A judge has ruled that the slide-to-unlock patent claim and nine others are invalid and that that their infringement on the gallery patent can be remedied by disposing of the application – they’ll likely update it to comply.

              More information after a natural English translation/account of the proceedings. A judge ruled that the reason Apple’s claims were invalid is due to prior art and function. Specifically, they point out a 2005 phone (before anyone even knew of the iPhone) called the Neonode that had a similar slide-to-unlock feature.

              They also said that the Galaxy S and S II’s device likeness claims are invalid due to the LG Prada – released well before the iPhone (2006) – taking precedence. Finally, the graphical user interface claim was thrown out due to the Nokia 7710, a 2004 phone that also boasted a grid-like interface for scrolling through applications.

                  all these lawsuits by apple are seriously pointless. yes the court might hv judged in favour of apple, who cares. by now samsung might be developing galaxy s3 or other successors to replace current models and will be soon anounced to public. whats apple going to do? delay iphone5 and put all their efforts to file another wave of lawsuits against sammy? ridiculous. samsung could hv just rename their galaxy sii into something say samsung galaxy i2 n re-enter the market with the same phone. furthermore, samsung will not be hit hard as their hv multiple phone models to support their business in d europe market while apple who adopted a single-phone strategy might be in trouble if their iphones are banned from lawsuits by nokia htc or samsung itself as apple hv nothing else other iphone itself in its portfolio. in conclusion, i really think that apple's effort this time around to be totally otiose.

                    You guys should really READ the article. The court banned it because of a gallery application, which is based on Android by Google. Samsung didn't infringe anything, and all they will have to do is update their phones with new gallery application.

                    The ban is on October, so Samsung has plenty of time to just swap out ONE application.
