Anonymous, 24 Aug 2011the problem is that no one wants to spent money on making s... moreI don't believe that people would do smuggling of non-Apple phones. There are just not worth it. You have to put those phones before someoone's eyes with thousands of arguments and low price just to get interested in considering it as an alternative to Apple.

According to this website the ban is actually meaningless and in fact samsung won the design copy issue

I really hope this is true and this stupid apple learns a lesson.

I smell something foul at play.
Not in memory have the courts every been so willing to place bans on the sale of items and usually bump it back to the respective companies to come up with some sort of settlement. Like we just recently saw in the US.
The European courts must be cheap to sway. Have their own agenda or like competition as much as Apple.

you know...if you can't handle competition in a sense of bissiness, then it's senseless being in a bissiness designed for competition.

Never in my life have I come across such a disgusting brainwashed hlrrible company as apple.I will never ever buy anything from the apple dictatorship because thats all it is!Why dont car companies sue each other as all cars do the same thing dont they, same as washing machines cookers tvs.The european gouvernment needs to halt this company in its tracks and let people choose what device they want to buy or use!!

Update: A dutch IP attorney has pointed out that the judge has ruled patent 1,964,922 to be null and void, meaning Apple can no longer make claims in the Netherlands based on this patent. The judge also found that Samsung did not infringe on patent 2,098,948. The infringement of 2,058,868 does not affect the Galaxy Tab 10.1.

There is one thing that i can not understand, why apple does not sue Samsung in the US? why in Germany?
is it that they have patented their technology in Germany or they think they can make German judges full better?
we are to see the real sale of SGSII in US soon.
I hate apple, more than before.

AnonD-16587, 24 Aug 2011Apple is not a product. Apple is interface. Everything that... morethe problem is that no one wants to spent money on making something different cause they know it won't catch on. This is because no matter how good or functional a product is these days, if apple doesn't make it then it wont get enough attention, since apple just sells anything they make to people who are not interested in the product but are just interested in the brand. In the end apple relies on other small and big companies to provide the hardware for their devices so i don't think samsung will be getting a huge blow but it will be interesting what apple will say when we end up smuggling any phone that isn't an iphone through the border cause it will be different and illegal

Out of 3 patents in question, only 1 is applicable. Patent 2,058,868 (the Gallery sh!t) is what Samsung (or should I say all 2.3 phones) infringing upon.
Rest 2 patents - 1,964,922 and 2,098,948 are not being infringed upon. Over that the design and "designs, copyrights and slavish (style) imitation" were all ignored by the court.
I think this is not too bad. Also, note that this is NOT across all EU. Apple did not produce enough documents in all countries or did not pay the bill at other places.
This gallery patent is still not valid in Austria, Belgium, Czech Republic, Estonia, Greece, Iceland, Italy, Latvia, Lithuania, Portugal, Romania, Slovenia, Slovakia, and Spain.
Infact, I now see that Engadget has reported 1,964,922 is null and void for apple.
UPDATE: Samsung lawyer has already mentioned in http://goo.gl/eZrek that Samsung will NOT stop selling. They are going to update the gallery apk soon.
