Apple is not a product. Apple is interface. Everything that is a product must have Apple's interface to be understood.
On the other side, originality won't help anyone either. They won't be readable by consumers, because they know only of Apple's visual paradigm.
Whoever tries to compete with Apple by being different, original and generally "good", they will most probably fail. Their only chance is to copy Apple and give more features for less money. And then they risk of being sued and banned.
It's a conspiracy alright :-)

Apple is right. If apple will not patent, then others will do and say it's theirs. AS microsoft did.you should remember that samsung is also suing apple for banning apple products.

(I'm from the Netherlands and just got this news a couple om minutes ago)
There is no problem with selling the Galaxy S, SII and Ace in Europe as of 13 oktober!
Samsung has just commented trough its lawyer, that it will have a software update for the picture gallery so it won't be violating the Apple patent any more ;)
Sales will continue like before.
All other claims from Apple regarding form-factors, screen and packaging were dismissed.
So it will be hard for Apple to win in the German court regarding these claims.
The Galaxy Tab is not affected by the ruling because it runs Gingerbread 3.1 which uses a other interface for the galary.

i love Samsung and his devices are one of the best, but if Apple is right, that Samsung stole those patents, it is not very cool, if they want to be top selling smartphone manufacturers. Apple created the iPhone, the iPad, devices that became insanely popular, so we should thank Apple for making those devices because without them we couldn't have the taste of Samsung, LG, Motorola, etc. Just want this to end fair and to see more upcoming mobile devices.

See how bias these courts are? All the blamed raining down on Samsung, while the Android OS is belonging to Google.
Better yet, how come Apple still hasn't get slammed for photoshopped the court evidence?

I live in the Netherlands and the patent in question is a piece of software, the Gallery-app to be precise. Samsung has already made clear that they'll keep selling the phones. They'll just change the software that violates Apple's patent.

REALLY? Patent something as trivial as scrolling and flipping through gallery? They stole notification system from android in iOS5, named it their invention, and they sue other companies over flipping through picutres? FFS In what world do I live in? If I would be a president, I would surely ban Apple for excessive stupidity.
