As throughout history...you tell humans to stop doing something, and they will completely ignore the warning and do it anyway. It's going to become a trend..."I live dangerously, I live on the endge, I have a note 7 pre-recall unit"

OEM like Samsung has list of IMEI of all it's devices. They will surely switch off all the unreturned devices in wild using OTA protocol.
And if you feel you are using one after above incidence, then probably it will be a replica ( not original) that you are using and neither Samsung nor anyone else will help you in case since it's not a legal instrument.

I find it strange how 90% of the phones that caught fire were all from America (iPhone land and land of the I will Sue your arse) just like only aliens land their UFOs in America hahahahaha, I will risk it and keep using my note 7 because no other phone on the market comes close and no I'm not a samsung fanboy I hate samsung I much prefer htc or sony but their flagships don't even come close to the note 7. If I it blows up in the 12 month contract shame on me but if it doesn't blow up in the next 10 month then I win and I will take a risk on that

Anonymous, 14 Oct 2016What if the customers refuse to return the handset, will th... moreCompany has already warned and instructed to turn off the device and return it. But if you ignore and keep it, it is your IRRESPONSIBILITY of carrying potentially dangerous content for self and others.
Quite possible that after deadline for return, if someone carries the device company will not be responsible, insurance companies too will deny any compensation ( since legally you are supposed to return but you didn't.it's a deliberate action of incidence rather than an accident). No law covers / compensates for deliberate illegal actions, when there is an official statement to surrender the patentially hazardous material.

Putting aside the exploding explosive issues, the Note 7 was the best phone made to date. Its understandable why some people might be hesitant to turn in their note 7's though it seems foolish to hold onto a phone which could among others be a potential fire hazard, will not get any more updates, Samsung could brick the phone at any time and has next to zero resale value.. Considering both Samsung and Apple are having major design refreshes next year, I'm going to wait for the S8, Note 8 and Iphone 8 (if AMOLED) to be released before replacing my S6.

Unfortunately, I couldn't buy Note7 because it was never released in my country. But if I could, I would have bought it and I would have only replaced it for Note8 (or whatever it will be called).
I would even buy it now if I could

What if the customers refuse to return the handset, will the company still need to be responsible for further incidents?
