It's up to driver developers to make them compatible with the OS. The reverse would be an absolute mess. MS cannot be held liable for this. This is from the legal aspect. From the moral aspect yeah they should be fined

"They only slowed performance in 6s and later if the battery is in less than optimal condition, as the phones used to shut down randomly in rough use cases", they probably used cheap batteries that degraded so much just after a year or two. It was their fault to begin with. Tempering with the behaviour of a smartphone without consent of their owner is outright atrocious.
"They even offered free battery replacements for one month and battery replacements at 1/3rd the price for entire one year", because they knew they had messed up pretty bad considering it's the same brand that is popular for its anti-consumer antics. They rarely recognize the issues on their devices.

So they released an unoptimized software update for Note 4, i guess they totally deserve the criticism/fine. I think it was more like their incompetence in software department than planned obsolescence, but you can't be so sure.
Their software department has come a long way in the last 2 years but they still need to improve on that.

Basically, there is only one instance of an update that led to poor performance. But that happens in iOS, MacOS and Windows updates all the time. Can they please also fine Windows for slowing my Windows 7 machine?

Google should sue Samsung for giving bad reputation for their Android OS. Android can run pretty smoothly, it could even run perfectly on old hardware.
Most people don't know about planned obsolescence. They are blaming Android's optimisation and saying that iOS is better and faster. But in reality, Android is very good OS, but Touchwiz (Samsung's modified Android) is very bad.

So… of course people will complaint about it since the update are coming from these companies that they've got a team of people to run it, mod it and then push the update to people's phone.
I mean, even iOS updates are a bit different for each model ( from 5, 6, 7, 8, to x, xs are receiving the update a bit different over times. Same thing with Android). Which is why people would think that the last update for you are there to slow down your phone( and people are even try find out if that's true or not, which is now that they found these 2 company guilty).
